For no-fault to apply, the marriage must have irretrievably broken down for at least six months. Adultery, abandonment for at least a year, cruel and inhuman treatment, incarceration for three or more years, and divorce after a year-long formal separation agreement or decree are examples of fault-based grounds. In order to move forward with a divorce, these grounds need to satisfy certain legal requirements.
